Terms of service
These Terms govern access to the FILHEX website, Windows application, and related File services. By using FILHEX you agree to them.
1. The agreement
These Terms of service (“Terms”) are a binding agreement between you and Filenk Tech, the operator of FILHEX (“we”, “us”). They cover the marketing website, the FILHEX Windows app, Workspaces, Credits, Solution Jobs, and related support.
Creating a Workspace, signing in, buying Credits, or otherwise using the Service means you accept these Terms and our Privacy policy. If you do not agree, do not use FILHEX.
We may update these Terms from time to time. The version published on this page applies when you use the Service. Continued use after a change means you accept the updated Terms.
2. Who may use FILHEX
You must be at least 18 years old (or the age of majority where you live, if higher) and able to enter a binding contract. If you act for a business, you confirm you are authorised to bind that business; “you” then includes that organisation.
FILHEX is built for professional tuning workshops and qualified automotive technicians. You confirm you have the skills and tools needed to handle ECU Files and flashing responsibly and lawfully.
3. What the Service does
FILHEX provides a Windows application and backend that let you upload an original ECU File, identify Brand and ECU where supported, select Solutions, run a Solution Job, and download a result File. Processing uses Credits from your Workspace wallet.
FILHEX runs the Solution Job and delivers the result File for workshop use. We do not flash vehicles, supply read/write hardware, or instruct you how to write Files to an ECU. You alone decide whether and how to use any File outside the app.
Catalog coverage is not guaranteed for every Brand, ECU, or File variant. Exact Solutions that apply are confirmed after upload and scan in the app.
4. Workspaces and accounts
You create a Workspace in the Windows app or on filhex.com/signup, verify your email, and keep login credentials confidential. You are responsible for activity under your Workspace, including Users you invite if that feature is available.
We may refuse, suspend, or close Workspaces that breach these Terms, abuse the Service, or create legal or security risk.
5. Credits and payment
1 Credit = 1 processed File when a Solution Job completes successfully (subject to product rules shown in the app). Scan and catalog browsing do not spend a Credit unless we clearly state otherwise.
New Workspaces may receive a signup Credit grant (for example, 5 free Credits) as described at signup and on pricing. Additional Credits are sold as packs via card checkout in the app (Stripe Checkout). Packs stack and do not expire unless a pack description says otherwise at purchase.
Prices and pack composition may change for future purchases. Taxes may apply depending on your location. Card payments are handled by our payment processor; we do not store full card numbers.
Digital Credits are delivered to the Workspace wallet after successful payment confirmation. Except where mandatory law requires otherwise, Credit pack purchases are non-refundable once Credits are credited to the wallet. Unjustified chargebacks may lead to suspension and recovery of costs.
6. Acceptable use
You must not:
- Use FILHEX in violation of applicable law, emissions rules, or road-safety requirements
- Attempt unauthorised access, disrupt the Service, or probe systems without permission
- Reverse engineer, scrape, or abuse APIs beyond normal app use
- Share Workspace credentials or resell access in a way that circumvents our billing
- Upload malware or content intended to harm the Service or other Users
- Misrepresent Files, payments, or identity
We may investigate suspected abuse and cooperate with authorities where required.
7. Intellectual property
The FILHEX name, branding, software, website, Catalog presentation, and documentation are owned by Filenk Tech or its licensors. You receive a limited, revocable right to use the Windows app and website for your professional workshop purposes under these Terms — not ownership of the software.
Original Files you upload remain your responsibility. Result Files are delivered for your Workspace use under these Terms; you do not acquire FILHEX trademarks or the right to rebrand our Service as your own platform.
Feedback you send may be used by us to improve the product without obligation to compensate you.
8. Support and File quality
Support focuses on original Files and normal Solution Job flows in the current app. We do not guarantee every requested Solution exists for every File, or that a result File is free of defects or fit for a particular vehicle. Files are provided on an “as is” basis for professional use at your own risk.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant uninterrupted operation, error-free Files, or compatibility with every tool or vehicle.
We are not responsible for damage to vehicles, engines, ECUs, tools, or computers arising from flashing, wiring, or other actions you take with Files; for warranty, emissions, or regulatory outcomes of your work; or for business interruption or lost profits related to your use of the Service.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from the Service or Files. Our aggregate liability for claims relating to the Service in any twelve-month period is limited to the amounts you paid us for Credits in that period (or, if none, zero beyond mandatory minimums).
Nothing in these Terms excludes liability that cannot be limited under applicable law.
11. Indemnity
You will defend and indemnify Filenk Tech against claims and costs arising from your use of Files, flashing or vehicle work, breach of these Terms, or violation of law or third-party rights — except to the extent caused by our wilful misconduct where local law requires.
12. Changes, suspension, and termination
We may modify features, Catalog presentation, pricing for new packs, or availability of the Service. We may suspend or terminate access for breach, fraud, chargeback abuse, or security reasons. Upon termination, your right to use the app under the Workspace ends; surviving clauses include IP, disclaimers, liability limits, indemnity, and this section.
13. Governing law
These Terms are governed by the laws applicable to Filenk Tech, without regard to conflict-of-law rules that would point elsewhere, except that mandatory consumer protections in your country of residence remain available where they cannot be waived.
Disputes should first be raised in writing via the contact below. If unresolved, courts with jurisdiction over Filenk Tech may hear the matter, without limiting mandatory forum rights you may have as a consumer.
